Terms of Service

These terms are an agreement between you and PIMDeck ("we", "us") for using pimdeck.com, the PIMDeck app, and the PIMDeck API (the "service"). By creating an account or using the service, you agree to them. If you accept on behalf of a company, you confirm you can bind it, and "you" means that company.

1. The service

PIMDeck is a product information management platform for businesses. It lets you manage a product catalog in one place, sync it to the sales channels you connect, and see stock reported by those channels. It is meant for business use, not for personal or household purposes.

2. Your account

You must give accurate information when registering and keep your credentials and API keys confidential. You are responsible for activity in your workspace, including that of users you invite. Tell us promptly athello@pimdeck.com if you suspect unauthorized access.

3. Plans and fees

The Free plan is free, subject to the limits shown on our pricing page. Paid or custom arrangements are agreed in writing (an order form or email) and set out the fees, term, and any extra commitments. Unless agreed otherwise, fees exclude taxes, which you are responsible for. We may change Free plan limits with reasonable notice; data you already have is not deleted because of a limit change.

4. Acceptable use

You will not use the service to break any law, infringe anyone's rights, sell prohibited goods, send malware or spam, probe or overload the platform, access other workspaces, or resell the service without our written consent. You are responsible for making sure the listings you publish comply with the laws of the markets you sell in.

5. Your data

Product, inventory, order, and customer data you put into PIMDeck ("your data") stays yours. You give us permission to host, copy, transmit, and process it only as needed to provide and support the service. We handle personal data as described in ourPrivacy Policy. You can export your data through the API at any time.

You confirm you have the rights and any notices or consents needed to give us your data, including personal data about your own customers.

6. Connected channels

When you connect a third-party channel (for example Shopify, Shopee, Lazada, or TikTok Shop), you authorize us to send and receive data with it on your behalf. Your use of that channel is governed by its own terms. We are not responsible for a channel's availability, changes to its API, or actions it takes on your listings or account.

7. API

You are responsible for requests made with your API keys. We may rate-limit or suspend API access that harms the platform's stability or security, and we will tell you when we do.

8. Availability and changes

We work to keep the service available and publish its status atstatus.pimdeck.com. We may improve, change, or remove features. If we remove a feature you rely on in a way that materially reduces the service, we will give reasonable notice.

9. Intellectual property and feedback

We own the PIMDeck platform, software, and brand. These terms give you the right to use the service, not ownership of it. If you send us suggestions, we may use them without obligation to you.

10. Disclaimer

Except as expressly stated in these terms, the service is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation, to the extent the law allows.

11. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, and our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim or USD 100. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or gross negligence.

12. Indemnity

You will defend and compensate us against third-party claims arising from your data, your listings, or your breach of these terms.

13. Suspension and termination

You can stop using PIMDeck and ask us to close your account at any time. We may suspend or close accounts that breach these terms or put the platform or other users at risk, with notice where reasonable. After closure you have 30 days to request an export of your data, after which we delete it as described in the Privacy Policy.

14. Export controls and sanctions

You will not use the service in breach of applicable export control or sanctions laws, or from a country or by a person subject to comprehensive sanctions.

15. Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. We will first try to resolve any dispute through good-faith discussion. If that fails, the courts of the Philippines have jurisdiction. If you are entitled by law to the protection of the mandatory laws or courts of your own country, nothing in this section takes that away.

16. Changes to these terms

We may update these terms as PIMDeck evolves. We will change the date above and, for material changes, email registered users at least 30 days before they take effect. Continuing to use the service after that means you accept the new terms.

17. General

If part of these terms is unenforceable, the rest still applies. Not enforcing a right is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a merger or sale of our business. These terms, plus any order form, are the whole agreement between us about the service.
